Copyright and Trademark Policy
1. Scope
This policy explains how [Registered legal name], which operates ClipMissions, deals with claims that material connected with ClipMissions infringes copyright, trade marks or related rights. It covers:
- material on the ClipMissions website and, once live, inside the Services, such as Brand footage, Mission Briefs, Submissions, evidence and showcase pages; and
- Clips posted by Clippers on their own Instagram, YouTube and X accounts as part of a Mission.
It forms part of our Terms of Use. It applies under the Copyright Act 1957, the Copyright Rules 2013, the Trade Marks Act 1999, the Information Technology Act 2000 and the IT Rules 2021, as amended.
2. How rights are respected on ClipMissions
- Brands must own or license everything they supply, including footage, music, performances and trade marks, as the Brand Terms require.
- Clippers must use only Mission materials, their own original work and properly licensed elements, as the Clipper Terms require.
- Both must respect the moral rights of authors under section 57 of the Copyright Act 1957, including the right to be credited and to object to harmful distortion.
3. How to send a notice
Send your notice by email to our Grievance Officer at [grievance email], with "Copyright notice" or "Trade mark notice" in the subject line, or by post to [Registered address]. To help us act quickly, please include:
- your full name, address, phone number and email address;
- whether you are the owner of the rights or are authorised to act for the owner, and if you are authorised, evidence of that authority;
- a description of the work or trade mark you say is infringed, with a copy or a link where possible;
- evidence of your ownership or licence, such as a registration certificate, a contract or proof of first publication;
- for a trade mark, the registration number, class and country of registration, or the basis of your rights if it is unregistered;
- the exact location of the material you complain about, such as the link to the Clip, post or page, and the time-stamp in a video;
- an explanation of why you believe the material infringes your rights, and why it is not covered by a licence or an exception in law, such as fair dealing for criticism, review or reporting;
- a statement that the information in your notice is accurate and that you are making it in good faith; and
- your physical or electronic signature.
Where the process for transient or incidental storage under the Copyright Act 1957 and the Copyright Rules 2013 applies, your notice should also contain the further details those rules require. If your notice is incomplete, we will tell you what is missing. We will acknowledge every notice within 24 hours.
4. What we do when we receive a valid notice
Material on ClipMissions itself
- We review the notice promptly. If it is complete and credible, we remove or disable access to the material on ClipMissions while the matter is resolved.
- Where the transient or incidental storage process under the Copyright Act applies, we keep access disabled for the period the law sets for you to obtain a court order, and restore it afterwards if no order is produced, unless we decide on our own review that it should stay down.
- We act on court orders and lawful government directions within the time the IT Rules require.
Missions and Submissions
- If the notice concerns Brand Materials, we may pause the whole Mission, ask the Brand for proof of rights and stop new Clips from being made.
- If the notice concerns a particular Clip, we may hold the Clipper Fee for that Submission while we look into it.
- We tell the Brand or Clipper concerned about the notice and give them a copy, with your personal contact details removed unless you agree otherwise, so that they can respond.
We aim to resolve every notice within 7 days, in line with our grievance timelines, and we will tell you what we have done.
5. Posts on Instagram, YouTube and X
Clips are published on the Clippers' own accounts on third-party platforms. We do not control those platforms and cannot remove posts from them ourselves. When a notice concerns such a post, we will:
- ask the Clipper to delete or edit the post, and require it under the Clipper Terms where the claim appears valid;
- stop counting views for that Submission and hold the related Clipper Fee while the matter is resolved;
- pause or end the Mission if the problem lies in the Brand Materials; and
- tell you that you can also report the post directly through the platform's own copyright or trade mark reporting tools, which can remove it faster.
If the claim relates to Brand Materials that the Clipper used exactly as supplied and as the brief allowed, the Clipper is protected under the Clipper Terms, and the Brand is responsible under the Brand Terms.
6. Counter-notice
If material you posted or supplied was removed or a Submission was held because of a notice, and you believe this was a mistake or that you have the right to use the material, you may send a counter-notice to [grievance email]. Please include:
- your full name, address, phone number and email address;
- the material that was removed or held, and where it appeared;
- the reason you believe the removal was a mistake, for example a licence, your own ownership, or an exception in law, with any supporting documents;
- a statement that the information is accurate and given in good faith;
- your agreement that we may share the counter-notice, including your contact details, with the person who sent the notice; and
- your physical or electronic signature.
We will send the counter-notice to the person who sent the original notice. If they do not show us, within [counter-notice restoration period], that they have started legal proceedings or obtained a court order, we may restore the material, release the held Clipper Fee and resume the Mission, unless our own review shows the material does infringe. Our decision does not decide the legal dispute between the parties, which only a court can do.
7. Repeat infringers
We keep a record of valid notices. We will suspend or close the account of any Clipper or Brand who repeatedly infringes others' rights, or who supplies or posts infringing material knowingly. A single serious case, such as knowingly supplying pirated footage, may be enough. Before closing an account under this section, we will tell the user and give them a chance to respond, unless the law prevents us.
8. Trade marks
Brand trade marks in Clips
Clippers may use a Brand's names and logos only as supplied in the Mission and only for that Mission. Clips must not use any other person's trade marks in a way that suggests a connection, sponsorship or endorsement that does not exist.
Platform trade marks
ClipMissions is independent. We are not affiliated with, sponsored by, endorsed by or partnered with Meta Platforms, Inc., Instagram, Google LLC, YouTube, X Corp., National Payments Corporation of India (NPCI), Cloudflare, Inc.
Instagram and Reels are trade marks of Meta Platforms, Inc. or its affiliates. YouTube, YouTube Shorts and Google Fonts are trade marks of Google LLC. X is a trade mark of X Corp. or its affiliates. UPI is a trade mark of National Payments Corporation of India. Cloudflare is a trade mark of Cloudflare, Inc. TikTok, which ClipMissions does not support, is a trade mark of its owner. We use these names only to describe the services our users work with, which we believe is honest descriptive use under the Trade Marks Act 1999. If you own one of these marks and have a concern about how we use it, please contact us.
The ClipMissions name
The ClipMissions name and logo identify our service. Please do not use them in a way that suggests we endorse or are connected with you without our written permission.
9. Misuse of this process
Please send notices only for genuine claims. Knowingly false notices or counter-notices can expose the sender to legal liability, and we may disregard notices that are abusive, made in bad faith or used to harass Clippers or competitors. We may share notices with the people affected and keep records of them.
